Terms of Use

PumpCal is owned and operated by Mynvoqe Labs LLC ("we", "us", "our"). These Terms of Use form a binding agreement between you and Mynvoqe Labs LLC covering the PumpCal mobile and web application, the AI Coach, the exercise library, nutrition features, and any related services (together, the "Service").

By creating an account, subscribing, or using the Service, you confirm that you have read, understood and accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

You must be at least 16 years old to create a PumpCal account. The minimum age must match the age declared in the App Store rating, the Google Play content rating, and the onboarding flow; Mynvoqe Labs LLC will keep those consistent.

You must also be legally able to enter into a contract in your country of residence, and you must not be barred from using the Service under applicable law.

You register with an email address and password, or by signing in with Google. You are responsible for keeping your credentials confidential and for all activity on your account.

• Use a password you do not reuse elsewhere.
• Do not share your account or let another person train under your profile.
• Tell us immediately at contact@mynvoqe.com if you believe your account has been accessed without your permission.

PumpCal personalises training, recovery and nutrition guidance from what you tell it: age, sex, height, weight, goals, equipment, injuries and limitations. Inaccurate or out-of-date information produces unsuitable guidance.

You agree to provide accurate information and to keep your profile, injuries and limitations current.

Subject to these Terms, Mynvoqe Labs LLC grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the Service for your own, non-commercial fitness and wellness purposes.

This is a licence, not a sale. All rights not expressly granted are reserved.

You must not:

• copy, redistribute, publicly perform, broadcast or resell the exercise videos, imagery, written guidance or any other content of the Service;
• use the Service to train, fine-tune, benchmark or build a competing model or dataset, or scrape it by automated means;
• reverse engineer, decompile or attempt to extract source code, model prompts or database contents, except where that restriction is prohibited by law;
• circumvent subscription checks, entitlement checks, rate limits or access controls;
• upload unlawful, infringing, abusive or sexually explicit content, or another person's photograph or health data without their permission;
• use the Service to give fitness, medical or nutrition advice to third parties as if it were your own professional judgement;
• interfere with the Service's security, availability or integrity.

The Service, including its software, design, user interface, motion and audio design, written exercise guidance, machine guides, nutrition content, coaching prompts, data compilations, graphics and marketing materials, is owned by Mynvoqe Labs LLC or licensed to it, and is protected by copyright and other laws.

"PumpCal", the PumpCal logo and the PumpCal visual identity are trademarks or unregistered marks of Mynvoqe Labs LLC. Trademark registration is being evaluated; the marks are used consistently in the meantime. You may not use them without prior written permission.

Certain exercise demonstration media in the Service is licensed from third parties and remains the property of those licensors. Your licence to use PumpCal does not transfer any rights in that media to you, and nothing in these Terms claims ownership of third-party licensed media.

"Your Content" means what you put into PumpCal: profile details, workout logs, body measurements, progress photos, food entries and food photos, notes, Coach messages, voice input and support messages.

You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, process and display Your Content strictly for the purposes of operating, securing and supporting the Service for you — for example, to store a progress photo, to analyse a meal photo you submit, or to give the Coach the context of your current exercise.

This licence exists only to run the Service. It ends when the content is deleted, except for copies retained as described in the Privacy Policy and the Account and Data Deletion Policy.

We do not use Your Content to train our own AI models. See the AI Disclosure for how third-party model providers process Coach and analysis requests.

You are responsible for what you upload. You confirm that you have the right to upload it, that it does not infringe anyone's rights, and that any person appearing in a photo you upload has consented.

Progress photos and food photos are personal and sensitive. Do not upload images of other people, minors, or documents containing another person's information.

Training plans, exercise demonstrations, load and rep suggestions, recovery readings, calorie and macronutrient estimates and meal guidance are general fitness and wellness information. They are not personalised medical, physiotherapy or dietetic prescriptions.

Read the Medical Disclaimer, the Exercise Risk Disclaimer and the Nutrition Disclaimer. They form part of these Terms.

The Coach is powered by artificial intelligence. It can be wrong, incomplete, out of date, or unsuitable for you. It does not know anything about you that you have not entered or connected, and it cannot see your form, your environment or your medical history.

Do not rely on the Coach for decisions where an error could harm you. Use your own judgement and consult a qualified professional. Full detail is in the AI Disclosure.

PumpCal is a fitness and wellness product. It does not diagnose, treat, cure, mitigate or prevent any disease or condition, and it is not intended to be used as a medical device.

Nothing in the Service is a substitute for professional medical advice, diagnosis or treatment.

PumpCal is not an emergency service and cannot contact one for you. If you experience chest pain, breathlessness, fainting, severe pain, or any other symptom you are concerned about, stop immediately and call your local emergency number or seek urgent medical care.

Speak to a physician or other qualified professional before starting or changing an exercise or nutrition programme, particularly if you are pregnant or postpartum, are recovering from injury or surgery, have a cardiovascular, metabolic, respiratory or musculoskeletal condition, take medication that affects heart rate, blood pressure or blood sugar, or have any symptom that concerns you.

Physical activity carries inherent risk of injury, and in rare cases serious injury or death. To the fullest extent permitted by law, you voluntarily assume the risks of the physical activity you choose to perform, whether or not it was suggested by PumpCal.

Waivers of liability for personal injury are limited or unenforceable in some jurisdictions. This clause applies only where and to the extent the law allows.

You are responsible for your training environment: safe flooring and space, working equipment, correct machine setup, collars and safety pins, spotters where appropriate, and following the equipment manufacturer's instructions. Machine guides in PumpCal are generic and may not match the specific machine in front of you.

Food identification, nutrition databases and label recognition can be wrong. PumpCal must not be used to determine whether a food is safe for an allergy, intolerance, or medically prescribed diet. Always verify ingredients and allergens on the product itself and with a qualified professional.

Fitness, body composition and health results depend on factors outside our control. We do not promise any specific outcome, timeline, weight change or performance improvement.

The Service integrates third parties, including the Apple App Store and Google Play for purchases, Apple Health and Android Health Connect where you enable them, and AI and nutrition-data providers described in the Privacy Policy. Their own terms and privacy policies govern their services. We are not responsible for third-party services or for content they provide.

We aim to keep the Service available, but it may be interrupted for maintenance, updates, network problems or events outside our control. Features may be added, changed, limited or removed. Where a change materially reduces a paid feature, we will act consistently with the Subscription Terms and applicable consumer law.

PumpCal is a subscription product. Access to premium features requires an active subscription. The Subscription Terms describe plans, renewal, cancellation and refunds, and form part of these Terms.

Where a free trial or promotional price is offered, its exact length, price and start of billing are shown before you purchase, on the purchase screen provided by the store. If you do not cancel before the trial ends, the subscription converts to a paid subscription at the renewal price shown.

Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the period through the store that sold you the subscription.

• iOS / iPadOS: Settings › your name › Subscriptions › PumpCal › Cancel Subscription.
• Android: Google Play › profile › Payments & subscriptions › Subscriptions › PumpCal › Cancel.
• Cancelling stops future renewals. You keep premium access until the end of the period you already paid for.

When you subscribe inside the app, Apple or Google is the merchant of record. They take payment, hold your payment details, issue receipts, apply taxes and control refunds. We never see your card details.

Refunds for in-app purchases are handled by Apple or Google under their policies, and by your mandatory rights under applicable consumer law (for example, statutory withdrawal rights in the EEA/UK). We cannot directly issue an Apple or Google refund.

If you believe you were charged in error, contact contact@mynvoqe.com and we will help you raise it with the correct store.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if your use creates a security, safety or fraud risk. You may stop using the Service and delete your account at any time.

Deleting your account removes your personal data as described in the Account and Data Deletion Policy. Deletion is permanent: workout history, body measurements, progress photos, nutrition logs and Coach conversations cannot be restored afterwards. Deleting your account does not cancel a store subscription — cancel that separately.

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate, recommendation or AI output will be accurate.

Some jurisdictions do not allow the exclusion of implied warranties; in those places this section applies only to the extent permitted.

To the fullest extent permitted by law, Mynvoqe Labs LLC and its officers, members, employees and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or lost opportunity, arising out of or relating to the Service.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the Service in the twelve months before the event giving rise to the claim, or the minimum amount required by applicable law.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law. The enforceability and the appropriate cap require attorney review.

Where legally enforceable, you agree to indemnify and hold harmless Mynvoqe Labs LLC against third-party claims arising from your breach of these Terms, your misuse of the Service, or content you upload. This section does not apply where it is prohibited by applicable consumer law.

These Terms are governed by the laws of the state in which Mynvoqe Labs LLC is organized, United States, without regard to conflict-of-law rules, except where the mandatory law of your country of residence applies to you as a consumer.

Contact us first at contact@mynvoqe.com. Most issues are resolved informally. If we cannot resolve a dispute within 60 days, either party may pursue the remedies available under the applicable law and forum.

No arbitration agreement and no class-action waiver applies to you. Disputes that cannot be resolved informally may be brought before a court of competent jurisdiction in the United States, or before the courts of your country of residence where consumer law gives you that right.

If you are a consumer in the EEA, the United Kingdom, Brazil, or another jurisdiction whose law grants you rights that cannot be waived by contract, nothing in these Terms removes or limits those rights. Where a clause conflicts with a mandatory consumer protection, that protection prevails and the rest of these Terms continue to apply.

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect and, where required, ask you to accept the new version. The version and date of the text you accepted is recorded in your account.

Where you obtained PumpCal from the Apple App Store, the following apply: this agreement is between you and us only, not with Apple; Apple has no obligation to provide support or maintenance for PumpCal; if PumpCal fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, and Apple has no other warranty obligation; Apple is not responsible for product-liability claims, third-party intellectual-property claims, or consumer-protection claims relating to PumpCal; and Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

Effective date: August 6, 2026. Version history is maintained with the document, and each version you accept is recorded against your account with its date and language.
